1. About SWMS Builder

SWMS Builder ("we", "us", "our") operates swmsbuilder.com.au, a web-based software tool that assists persons conducting a business or undertaking (PCBUs) and workers in preparing Safe Work Method Statement (SWMS) documents. SWMS Builder is operated under an Australian Business Number (ABN) registered in Western Australia.

2. Not legal or WHS advice

SWMS Builder is a document preparation tool only. Nothing on this platform or in any generated document constitutes legal advice, WHS compliance advice, or a guarantee of regulatory compliance. You must ensure all SWMS documents are reviewed by a competent person before use on site. For legal advice, consult a qualified lawyer or WHS practitioner.

3. User responsibilities

By using SWMS Builder, you agree that:

• You are responsible for the accuracy, completeness, and site-specific suitability of all information you enter.
• You will have all generated SWMS documents reviewed by a competent person before use.
• Your obligations under the Work Health and Safety Act 2020 (WA), WHS Regulation 2022, and any other applicable WHS legislation remain entirely with you as the PCBU.
• You will update the SWMS whenever site conditions, hazards, or controls change.
• You will not rely solely on SWMS Builder templates without verifying their suitability for your specific work and site.

4. Limitation of liability

To the maximum extent permitted by Australian Consumer Law, SWMS Builder Pty Ltd and its operators, directors, employees, and agents are not liable for any loss, damage, injury, fine, penalty, or regulatory action arising from the use of documents generated by this platform. This includes but is not limited to: workplace injuries, worker fatalities, regulatory investigations, or penalties imposed by SafeWork WA or the NDIS Quality and Safeguards Commission.

5. Subscriptions and billing

SWMS Builder offers free and paid subscription plans billed in Australian Dollars (AUD). Subscriptions are processed via Stripe. You may cancel your subscription at any time through your account dashboard or the Stripe Customer Portal. Cancellation takes effect at the end of your current billing period. Refunds are handled at our discretion in accordance with Australian Consumer Law. We reserve the right to change pricing with 30 days' notice to existing subscribers.

6. GST

SWMS Builder is registered (or will register when required) for GST in Australia. Prices displayed are inclusive of GST where applicable. Tax invoices are available in your account dashboard.

7. Intellectual property

The SWMS Builder software, templates, and content are the intellectual property of SWMS Builder Pty Ltd. The SWMS documents you create using this tool are your property. By using our platform, you grant us a limited licence to process and store your data for the purpose of providing the service.

8. Privacy

We collect personal information necessary to provide the service (name, email, company details, and document data). We do not sell your data. We comply with the Australian Privacy Act 1988. See our full Privacy Policy at swmsbuilder.com.au/legal/privacy.

9. Acceptable use

You must not use SWMS Builder to create fraudulent documents, misrepresent workplace safety conditions, or breach any applicable law. We reserve the right to suspend accounts that violate these terms.

10. Governing law

These Terms are governed by the laws of Western Australia, Australia. Disputes are subject to the exclusive jurisdiction of the courts of Western Australia.
